Hardship Waiver
The end date for submitting a hardship waiver for the upcoming school year is July 31st.
A hardship waiver may be granted when extenuating circumstances exist for a family and those circumstances necessitate the placement of the student at a different school than the current school of enrollment. Hardship Waivers are available in your FOCUS Parent Portal under Forms and Enrollment Waiver Request.
To assist with defining what might qualify as extenuating circumstances the following are NOT considered extenuating circumstances that would be granted a hardship:
1. Personal Preference or Convenience
Wanting a specific school or environment without a compelling, unmanageable hardship is routinely denied:
-
School Ranking or Reputation: Liking a school's academic reputation, athletics, electives, or social environment better than the assigned school.
-
Routine Commute & Traffic: Standard distance, travel time, or heavy traffic, provided transportation or standard busing is available.
-
Sibling Placement (in some districts): An older sibling requesting a transfer to a younger sibling's school solely for family convenience (unless specific sibling-preference policies exist).
-
Dislike of Assigned Teachers/Staff: General dissatisfaction with school leadership or teachers without evidence of severe, unaddressed safety issues or legal violations.
2. Routine Childcare & Work Schedules
While scheduling conflicts are frustrating, standard family logistics do not meet the bar:
-
Parental Work Hours: Standard work shifts that conflict with school start/stop times.
-
Informal Childcare Arrangements: Wanting a child closer to a grandparent's home, babysitter, or neighborhood friend simply for convenient drop-offs/pick-ups.
3. Non-Qualifying or Undocumented Health Claims
Medical or psychological waivers require concrete, specialized medical necessity:
-
Common Minor Illnesses: Standard, manageable conditions (e.g., mild asthma, seasonal allergies, short-term colds).
-
Unsubstantiated Mental Health Claims: Statements regarding anxiety, stress, or social adjustment without an official diagnosis or treatment plan from a licensed doctor or mental health professional.
-
Services Available Elsewhere: Claiming a medical need that the student's assigned home school is legally equipped to accommodate (e.g., standard IEP or 504 plan accommodations).
4. Self-Imposed or Preventable Delays
School boards rarely grant hardship waivers to resolve issues caused by a failure to follow standard procedures:
-
Missing Deadlines: Forgetting enrollment dates, late submission of forms, or missing school choice open enrollment windows.
-
Lack of Documentation: Failing to provide required proof (e.g., utility bills for residency, custody paperwork, or official physician letters).
5. Standard Life Transitions
Normal adjustments that all families go through rarely qualify on their own:
-
Routine Moves: Moving to a new neighborhood within the district during the summer, where standard school assignment applies.
-
General Adjustment Discomfort: A student missing former friends or finding it hard to fit into a new school culture.
Notice to Parents & Guardians Seeking Hardship Waivers Related to Bullying or Harassment
Before Requesting a Hardship Waiver: If your hardship request is based on safety concerns, bullying, or harassment, please note that a Hardship Waiver is not the primary mechanism for reporting or resolving these issues within the district.
To ensure student safety and allow the district to formally investigate and take immediate action, families should complete a formal bullying request instead of, or prior to, submitting a hardship waiver request.
How to File a Bullying Report:
-
-
Submission: Return the completed form directly to your child's school Administrative Office or to the Lee County Public Education Center – Student Services Department (2855 Colonial Blvd, Fort Myers, FL 33966). Reports can also be submitted anonymously if preferred.
-
Direct Reporting: You may also report incidents directly in person or by phone to school personnel.
For further policies under the Jeffrey Johnston Stand Up for All Students Act, please consult the district's page or contact Student Services at (239) 334-1102.
